This sample contract contains the full text of a printed contract you are expected to agree to and sign at the time of purchase. The portions missing here are those pertaining to the specific dog being sold and the signature lines for the Seller and the Buyer.

Buyer shall purchase and Seller shall sell the above described dog in consideration of $______ (minus any previously paid deposit) cash in hand or bank draft, receipt acknowledged, subject to the following conditions of sale:

  1. Seller warrants that on the date first appearing above, the dog appears to be free from any communicable diseases, is in apparent good health, and is free from apparent wounds or injuries, except as may be noted herein. Buyer shall have the dog examined by a veterinarian within 5 days after delivery and should the veterinarian certify in writing that the dog is ill or unsound, the buyer may elect to return the dog for a full refund of the purchase price.
  2. This dog is being sold as a companion and family member. The Seller will register the dog with the Canadian Kennel Club (CKC) using the Seller's prefix Solna.
  3. The Buyer assumes all responsibility for care of this dog, except as noted elsewhere in this Agreement The Buyer agrees to indemnify and hold Seller harmless from and against any and all liabilities, demands, claims, causes of action and damages, except as specifically enumerated herein.
  4. Buyer agrees to spay/neuter the dog between 5-12 months of age.
  5. Should Buyer choose to resell or place the dog at a later time, Seller shall be given the first opportunity to repurchase the dog at no more than 1/2 the original price. Should the dog be sold or placed with anyone other than the seller, the new purchaser must be willing to sign a like contract with Seller. Buyer shall inform Seller of the name and address of the new owner.
  6. In the event of the death of the Buyer, full ownership of the dog will be transferred back to the Seller, except in the event that a member of the Buyer's immediate family wishes to retain ownership of the dog. Other requests for transfers will be considered with the best interest of the dog in mind. No money shall change hands at the time of transfer of dog. The new owner must agree to sign a like contract with the Seller and inform Seller of their address and phone number.
  7. Buyer shall not, under any circumstances sell, give or lease the dog to any pet shop, pet farm, research laboratory or similar institution. Any attempts to do so shall be invalid and Seller shall be entitled to repossess the dog without refund of purchase price. Buyer shall be responsible for all costs of repossession, including reasonable attorney's fees.
  8. The dog shall be subject to repossession by Seller without refund of purchase price in the event Buyer commits or permits to be committed cruelty or neglect to the dog. "Cruelty" or "neglect" for this purpose shall include, but not be limited to, the following:
    1. inadequate health maintenance (nutrition, water, veterinary care including vaccinations, or physical cleanliness)
    2. repeatedly being allowed to run at large in public area or maintained under conditions that create a public nuisance, or endanger the dog's welfare or safety
  9. Buyer shall notify Seller immediately in case of serious illness or injury to the dog, to enable Seller to consult with her veterinarian for possible treatment, or in the event of the death of the dog from any cause. An attending veterinarian's report shall be furnished to the Seller in the event of the dog's untimely death. Seller may, at her option and expense, require an autopsy to be performed. In the event the dog is found to have died from neglect or mistreatment through the fault of the Buyer, Buyer shall pay the entire cost of the autopsy.
  10. The Seller makes no guarantees, implied or expressed, that the dog will not acquire one or several of the diseases/conditions common to the Pug breed, including but not limited to hip dysplasia, patellar luxation, Legg-Perthes, entropion, stenotic nares, elongated soft palate or Pug Dog Encephalitis.
  11. The Seller guarantees that, in the event that the above mentioned animal is diagnosed by a board certified veterinary specialist in the specific related field, with a hereditary/congenital defect resulting in a significantly shortened lifespan (i.e. dog dies or has to be eudianized prior to 5 years of age because of this diagnosed defect and the accepted current veterinary medical therapies have failed to afford the dog an acceptable quality of life, as determined by the Seller), the Seller will replace the dog with another puppy from a mutually agreeable sire and dam, within one and one half years after the death of the original dog. There will be no additional charge for the replacement puppy.
  12. Buyer shall furnish Seller with periodic written reports and photographs of the dog.
  13. Buyer shall notify Seller of any change of address or phone number in a timely fashion.
This Agreement constitutes the entire understanding of the parties and may only be modified or amended by a written document signed by the party to be charged. This Agreement is binding upon Buyer, Seller and their heirs, agents and assigns. No assignment of right under this Agreement may be made by Buyer without the prior written approval of Seller. In the event that any one or more of the provisions (or the applications thereof) contained in this Agreement shall be invalid, illegal or unenforceable in any respect, the validity, legality or enforceability of the remaining provisions of this Agreement, or any other application thereof, shall not in any way be affected or impaired; provided however, that to the extent permitted by applicable law, any invalid, illegal or unenforceable provisions may be considered for the purpose of determining the intent of the parties in connection with the other provisions of this Agreement.

This Agreement is made for the mutual benefit and protection of Buyer and Seller, for the protection of the named dog, and for the protection and preservation of the Pug breed. This agreement shall be construed and applied according to the laws of the Province of Ontario.
